Facts

The child was born in 2011 in Spain of a Brazilian mother and Spanish father. 

In 2013, the family lived in Brazil for a while. In 2014, the father, mother and child returned to Spain. However, the mother and child established their residence in a different city from the father. The child enrolled at school in Spain for the 2014/2015 term. 

The mother travelled with the child to Brazil in September 2014. The father contacted the Central Authority of Spain in October 2014, alleging wrongful removal under the 1980 Child Abduction Convention. 

Judicial proceedings seeking the return of the child were initiated in Brazil in 2015 by the State Attorney of the Federal Government (União). 

The First Instance decision denied the application of the Hague Convention on the grounds that the country of habitual residence of the child was Brazil. The First Instance decision was overturned by the Second Instance judgment, which ordered the return of the child to Spain. The mother sought to review the decision ordering the return at the Superior Appellate Court (Superior Tribunal de Justiça).

The Court found it unviable to analyse the allegation of de facto custody of the mother at the Superior instance. The lower Court decision had already analysed the evidence and recognised that Spain was the country of habitual residence of the child, where the family moved intending to stay in 2014. The Court found that the wrongful removal was characterised, relying on the analysis of the evidence by the lower Court, which established that the taking of the child by the mother to Brazil in 2014 happened without the consent of the father. 

Interpretation of the Convention

Article 12 of the Convention establishes the duty to return the child forthwith if a period of less than one year has elapsed at the date of the commencement of the proceedings, counting from the date of the wrongful removal or retention. The Court found that the exceptions to order the return are to be interpreted narrowly to allow the Convention to fulfil its purpose. The Court noted that the duration of proceedings is not to be considered for the effect of the one-year timeframe under Article 12. The Court concluded that only very exceptional circumstances would authorise not ordering the return, for example, the excessive length of the proceedings in light of particular circumstances of the case, such as the separation of siblings.  

In this case, the removal happened in September 2014. The Central Authority of Spain was contacted in October 2014, which transmitted the request for cooperation to the Brazilian Central Authority in February 2015. The proceedings were undoubtedly commenced in less than one year since the wrongful removal. 

Hechos

El niño había nacido en 2011 en España, de madre brasileña y padre español.

En 2013, la familia vivió en Brasil durante un tiempo. En 2014, el padre, la madre y el menor volvieron a España. Sin embargo, la madre y el niño establecieron su residencia en una ciudad diferente de la del padre. El niño fue inscripto en una escuela en España para el ciclo lectivo 2014/2015.

En septiembre de 2014, la madre viajó con el menor a Brasil. El padre contactó a la Autoridad Central de España en octubre de 2014 e informó un presunto traslado ilícito con arreglo al Convenio de Sustracción de Menores de 1980.

El fiscal del Gobierno Federal (União) inició un proceso judicial en Brasil en 2015, a fin de restituir al niño.

La primera instancia rechazó la solicitud en virtud del Convenio de la Haya sobre la base de que el país de residencia habitual del menor era Brasil. La decisión de la primera instancia fue revocada por una sentencia en segunda instancia, la cual ordenaba la restitución del niño a España. La madre solicitó la revisión de la decisión que ordenaba la restitución ante el Tribunal Superior de Apelaciones (Superior Tribunal de Justiça).

Fallo

Apelación desestimada, restitución ordenada.

Fundamentos

Traslado y retención - arts. 3 y 12

El tribunal determinó que no era viable analizar lo alegado en cuanto a la custodia de hecho de la madre en la instancia superior. La decisión del Tribunal inferior ya había analizado las pruebas y reconocido que España era el país de residencia habitual del menor, al cual se había mudado la familia en 2014 para quedarse. El tribunal determinó que el traslado ilícito se encontraba caracterizado, en función del análisis de las pruebas realizado por el tribunal inferior, que estableció que, en 2014, la madre se llevó al niño a Brasil sin el consentimiento del padre.

Interpretación del Convenio

El artículo 12 del Convenio establece el deber de restituir al niño de manera inmediata si ha transcurrido un plazo menor a un año en la fecha de comienzo de las actuaciones procesales, a partir de la fecha del traslado ilícito o la retención. El tribunal determinó que las excepciones para ordenar la restitución deben interpretarse de una manera restringida, a fin de permitir que el Convenio cumpla con su objetivo. El tribunal observó que no se debe tener en cuenta la duración de las actuaciones a efectos del plazo de un año previsto en el artículo 12. El tribunal llegó a la conclusión de que únicamente circunstancias excepcionales autorizarían la no restitución del menor, por ejemplo, la duración excesiva de las actuaciones a la luz de las circunstancias particulares del caso, como la separación de hermanos.

En este caso, el traslado tuvo lugar en septiembre de 2014. La Autoridad Central de España fue contactada en octubre de 2014, y esta transmitió la solicitud de cooperación a la Autoridad Central brasileña en febrero de 2015. Las actuaciones procesales, indudablemente, comenzaron dentro del año posterior al traslado ilícito.
