Facts

The parents got married in 2005 in California, United States of America. The couple had two children: a boy in 2008, and a girl in 2010. In 2005, the mother was diagnosed with a malignant brain tumor and had difficulties regarding the care of her children. In April 2010, the parents decided to grant an authorisation so the boy could move to Santa Ana, El Salvador, with his maternal grandmother and the father could devote himself fully to take care of the mother. After the girl was born, the mother's condition deteriorated and, in July of the same year, the parents decided to grant an authorisation so the girl could also move to El Salvador with her brother and maternal family.

At the end of 2010, the mother travelled to El Salvador and passed away in March 2012. The father learnt about this the day following her death. He tried to communicate with the mother's family, but he was unable to do so. Thus, he filed a lawsuit before the Salvadoran embassy located in Washington D.C. He later contacted the US embassy in El Salvador, which took measures so that the maternal family would return the children to him.

Since the maternal family refused to return the children, the father travelled to El Salvador, went to the maternal family's flat, but was unable to take the children with him. As a consequence, he brought all administrative and legal proceedings which were necessary to recover them. Finally, at the beginning of August, he filed a petition for return.

In August 2012, the Court with jurisdiction over minors (Juzgado Especializado en la Niñez y Adolescencia) in Santa Ana ordered the immediate return of the children. It held that the children were wrongfully retained by the maternal grandmother and aunt. The grandmother and aunt appealed the decision on the basis of lis pendes since a lawsuit was filed in July 2012 before the Court with jurisdiction over family matters (Juzgado de Familia) in Santa Ana over the loss of parental authority. Moreover, they stated that granting the return would not guarantee the regular course of the proceedings. They also argued that the father was not fit to exercise the duties of a parent and that he had not been granted legal custody of the children and,  finally, that the father had completely abandoned the children.

Ruling

Appeal refused; return allowed. It was settled that the retention was wrongful.

Grounds

Rights of Custody - Art. 3

The grandmother of the children stated that it had never been duly proved that the father had the legal custody of the children. She claimed the existence of a written consent signed by her daughter before a notary public, which authorised the grandmother and aunt to take care of the children. In this proceeding, the father proved that he had authorised the children to leave the United States of America within the context of his wife's illness in order to devote himself to her care.

The Court held that Article 3 states the first rule to establish the existence of a right of custody: as a general rule, the father and the mother of a child are automatically attributed parental responsibility by operation of law. Then, all administrative and judicial laws of each State can be taken into consideration.

The father had custody rights by operation of law. Consequently, he did not need an administrative or judicial decision recognizing his rigths. 

The Court also held that grandparents and the rest of family Members have contact rights, according to the El Salvador laws and as a general rule; and their possibility of having custody rights is exceptional. Consequently, the pretended custody rights argued by the grandmother and rest of the mother's family are not in accordance with the Family Code of El Salvador.

Consent - Art. 13(1)(a)

The Court of Appeal highlighted that written consent did not mean the release from parental responsibility for the mother and father under any circumstances. It held that such delegation should be considered temporary, taking into consideration the urgency of the circumstances.

Procedural Matters

One of the arguments stated by the grandmother and aunt against the judgment of the Court with jurisdiction over minors focused on non-compliance with Article 8, paragraph 3, e) and f), by virtue of which the existence of the father’s right of custody did not appear to be demonstrated. In response to these arguments, the Court of Appeal analysed the nature of the sections of this paragraph and held that, up to section d), the rule was structured as a mandatory provision with a view to identifying the children and their  location. The rest of the sections (sections e) to g) ) were conceived as optional requirements, so the applicant was able to decide whether or not to include the documents set forth in such paragraphs at their own discretion.

It was further contended tby the mother that the decision of the first instance court in ordering the return of the child did not guarantee the regular course of the proceeding regarding the case she had initiated against the father for the loss of parental authority (filed before the First Instance Court with jurisdiction over family matters (Juzgado Segundo de Familia) in Santa Ana). The judgment of the Court of Appeal set aside the extension of the interim custody measure which had been ordered by the First Instance Court. The Court applied Article 16 of the Convention which sets forth the preferential application of the Convention over the initiation of any other proceedings where a decision on  the custody of a child involved in a return proceeding could be entered. It was held that this rule binds judges to unofficially suspend the proceedings until all matters relating to the return have been decided upon.

The proceedings lasted a little over a month since the return petition was filed until the return was ordered by the Court of Appeals.

Hechos

Los padres contrajeron matrimonio en el año 2005, en el Estado de California, Estados Unidos de América. De dicha unión matrimonial nacieron dos hijos, un niño, en el año 2008, y una niña, en el año 2010. En el año 2005 la madre fue diagnosticada con un tumor cerebral maligno, complicándosele el cuidado y la atención de sus hijos. En abril de 2010 los padres decidieron otorgar un permiso para que el niño fuera a vivir a Santa Ana, El Salvador, con su abuela materna para poder ocuparse plenamente de la enfermedad de la madre. Luego del nacimiento de la niña el estado de salud de la madre desmejoró y en julio del mismo año decidieron otorgar permiso para que la niña también viajara a El Salvador para vivir junto con su hermano y la familia materna.

A finales de 2010 la madre de los niños viajó a El Salvador y falleció en marzo de 2012. El padre se enteró al día siguiente del deceso por lo que intentó comunicarse con la familia de la madre sin poder hacerlo, por lo que interpuso una denuncia en la embajada de El Salvadorcon sede en Washington D.C. Tomó, luego, contacto con la embajada norteamericana en El Salvador quienes intentaron que la familia materna entregara a los niños al padre. 

Frente a la negativa, el padre de los niños viajó a El Salvador, se presentó en el domicilio de la familia materna sin poder llevarse consigo a los hijos y, a partir de ese momento, realizó todas las acciones administrativas y judiciales necesarias para recuperar a sus hijos. Finalmente, a principios de agosto, solicitó la restitución de los niños.

En agosto de 2012 la Jueza Especializada de la Niñez y Adolescencia de Santa Ana pronunció sentencia ordenando la restitución inmediata de los niños por existir retención ilícita por parte de la abuela y la tía materna. Tal resolución motivó el recurso de apelación interpuesto por la abuela y tía maternas, argumentando la existencia de un incidente de litispendencia ya que existía un proceso iniciado en julio de 2012 de pérdida de autoridad parental ante el Juzgado de Familia de Santa Ana, y que de otorgarse la restitución de los niños no se estaba garantizando el normal desarrollo del proceso. Por otro lado, adujeron que el padre de los niños no era idóneo para ejercer su función parental y que no se había acreditado la existencia de un derecho de custodia a favor del progenitor y que, en realidad, había un abandono absoluto de sus hijos.

Fallo

Apelación denegada, restitución concedida. La retención fue considerada ilícita.

Fundamentos

Derechos de custodia - art. 3

La abuela de los niños alegó que no se había probado debidamente que existiera un derecho de custodia a favor del padre, invocando la existencia de una autorización escrita firmada por su hija ante escribano público mediante la cual autoriza al cuidado personal de sus hijos a su abuela y a su tía materna. En el caso, el padre de los niños probó que había autorizado la salida de Estados Unidos de su hijo y de su hija pero que ello se había dado en el contexto de la enfermedad de su esposa, a fin de favorecer las condiciones de tiempo para atención de la misma. 

El tribunal consideró que el artículo 3 establece el primer supuesto de existencia de un derecho de custodia: la atribución de pleno derecho que corresponde, por regla general, al padre y a la madre. El padre gozaba de la atribución del derecho de custodia de pleno derecho, por lo que no requería de una decisión administrativa o judicial para que le fuera atribuido tal derecho. 

A su vez, el Tribunal manifestó que, los abuelos, abuelas y demás miembros de la familia ampliada tienen, de conformidad con la legislación de El Salvador y como regla general, un derecho de comunicación y trato con sus nietos, y solo excepcionalmente, la posibilidad de ostentar la custodia de estos. Por tanto el pretendido derecho de custodia que se pretenden arrogar, a los fines de la aplicación del convenio la abuela y demás miembros de la familia materna no se adecua a las disposiciones del Código de Familia de El Salvador.

Consentimiento - art. 13(1)(a)

La Cámara hizo hincapié en que una autorización escrita no podía significar, bajo ninguna circunstancia, el relevo de las responsabilidades que implica para el padre y la madre el ejercicio de la responsabilidad parental. Debe entenderse que tal delegación es temporal, atendiendo a circunstancias de suma urgencia. 

Cuestiones procesales

Uno de los argumentos planteados por la parte demanda al fallo de la Jueza Especializada de la Niñez y Adolescencia se centraba en la inobservancia del art. 8 inciso 3, e) y f), en virtud de los cuales no quedaría demostrado fehacientemente que existía un derecho de custodia efectivo a favor del padre de los niños. La Cámara, frente a estas manifestaciones, analizó el carácter de los apartados de este inciso y entendió que hasta el inciso d) la norma se estructuró de manera obligatoria con la finalidad de identificar e individualizar a los niños y su ubicación geográfica, y que luego se articuló facultativamente, quedando a criterio del denunciante incorporar o no la documentación enumerada en estos incisos. 

Por otro lado, se cuestionó que la decisión de la jueza de primera instancia no garantizaba el normal desarrollo del proceso de pérdida de autoridad parental iniciado en el Juzgado Segundo de Familia de Santa Ana. El fallo de la Cámara dejó sin efecto la prórroga de la medida de custodia provisional dictada por el Juzgado de primera instancia. La Cámara aplicó el artículo 16 del Convenio donde se establece la aplicación preferente del Convenio por sobre la iniciación de cualquier otro proceso en el que pueda pronunciarse una decisión sobre la custodia del niño que esté involucrado en una solicitud de restitución. Se entendió que esta regla obliga a los jueces a suspender oficiosamente los procesos hasta que lo relativo a la restitución no se hubiera decidido.

El proceso duró poco más de un mes desde que se solicitó la restitución del niño y la niña hasta que se ordenara la restitución por la Cámara.
