Facts

The child, a boy, was 14 months at the date of the alleged wrongful removal. He had lived in the United States since birth. The parents were married and had joint rights of custody. On 25 September 1992 the mother took the child to England, her State of origin.

The father filed for the return of the child shortly thereafter.

On 19 February 1993 the mother's application for a visa to visit the United States was refused.

Ruling

Removal wrongful and return ordered, subject to undertakings; the standard required under Article 13(1)(b) to indicate that the child would face a grave risk of psychological harm had not been met.

Grounds

Grave Risk - Art. 13(1)(b)

The court questioned whether the mother would be refused a visa to the United States, in order to contest custody proceedings in Texas, if the application was backed by an order of the court. Even if the mother failed to obtain a visa, the facts did not establish that the child would be exposed to psychological harm of the necessary degree or placed in an intolerable situation as required by Article 13(1)(b). Affidavit evidence from two psychologists to the contrary did not sway the court.

Undertakings

The father made several undertakings to the court, notably to issue proceedings forthwith in the relevant court in Texas and to pay for the return of the mother and child.

INCADAT comment

Ultimately the father did not comply with the undertakings or otherwise seek to enforce the order. Three and a half years later the mother successfully appealed to have the order dismissed; see: Re L. (A Minor) 29 November 1996, transcript, Court of Appeal [INCADAT Reference: HC/E/UKe 182].

UK - England and Wales Case Law

The English Court of Appeal has taken a very strict approach to Article 13 (1) b) and it is rare indeed for the exception to be upheld.  Examples of where the standard has been reached include:

Faits

L'enfant, un garçon, était âgé de 14 mois à la date du déplacement dont le caractère illicite était allégué. Il avait vécu aux Etats-Unis depuis sa naissance. Les parents étaient mariés et disposaient d'un droit de garde conjoint. Le 25 septembre 1992, la mère emmena l'enfant en Angleterre, dont elle était originaire.

Le père forma très rapidement une demande de retour de l'enfant.

Le 19 fevrier 1993, la demande de visa pour les Etas-Unis sur la parte de la mère a été rejeté.

Dispositif

Déplacement illicite et retour ordonné, des engagements étant pris ; les conditions de l'article 13 (1)(b) tendant à montrer que l'enfant serait exposé à un risque grave de danger psychologique n'étaient pas remplies.

Motifs

Risque grave - art. 13(1)(b)

Le juge se demanda si la mère pouvait se voir refuser une demande de visa pour les Etats-Unis lui permettant d’intervenir à la procédure de garde au Texas, en cas de retour de l’enfant. Même si la mère ne parvenait pas à obtenir un visa, il n’était pas établi que l’enfant se trouverait exposé à un danger psychologique ou placé dans une situation intolérable suffisamment graves pour remplir les conditions de l’article 13 alinéa 1 b. Les témoignages des deux psychologues attestant du contraire ne suffirent pas à convaincre le juge.

Engagements

Le père prit divers engagements auprès de la Cour, tendant notamment à introduire immédiatement une instance devant la juridiction texane compétente et à prendre en charge financièrement le retour de la mère et de l’enfant.

Commentaire INCADAT

Finalement, le père ne respecta pas les engagements ni ne chercha à exécuter la décision. Trois ans et demi plus tard, la mère vit son appel accueilli et le jugement du premier juge infirmé. Voy. : Re L. (A Minor) 29 novembre 1996, transcription, Court of Appeal [Référence INCADAT: HC/E/UKe 182].

Jurisprudence du Royaume-Uni - Angleterre et Pays de Galles

Hechos

El menor tenía 14 meses a la fecha de la supuesta sustracción ilícita. Había vivido en los Estados Unidos desde su nacimiento. Los padres se encontraban casados y tenían derechos de custodia compartida. El 25 de septiembre de 1992 la madre se llevó al niño a Inglaterra, su Estado de origen.

El padre solicitó la restitución del menor poco después.

El 19 de febrero de 1993 se rechazó la solicitud de la madre de una visa para visitar los Estados Unidos.

Fallo

Traslado ilícita y restitución ordenada, sujeta a compromisos; no se había alcanzado el estándar requerido por el artículo 13, apartado (1), letra (b) para indicar que el menor enfrentaría un grave riesgo de daño psicológico.

Fundamentos

Grave riesgo - art. 13(1)(b)

El tribunal se preguntó si se le rechazaría a la madre una visa para los Estados Unidos, a fin de contestar el proceso por la custodia en Texas, si la solicitud era respaldada por una orden del tribunal. Aun en caso de que la madre no obtuviera la visa, los hechos no determinaban que el menor sería expuesto a un daño psicológico de semejante grado, ni que se lo colocaría en una situación intolerable, tal lo requerido por el artículo 13, apartado (1), letra (b). La prueba de declaración jurada de dos psicólogos en sentido contrario no modificó la opinión del tribunal.

Compromisos

El padre asumió varios compromisos ante el tribunal, principalmente el de iniciar en forma inmediata un proceso ante el tribunal competente de Texas y pagar el regreso de la madre y el menor.

Comentario INCADAT

Finalmente, el padre no cumplió con los compromiso no buscó ejecutar la orden de otra manera. Tres años y medio después la madre logró apelar y dejar sin efecto la decisión; véase: Re L. (A Minor) 29 November 1996, transcript, Court of Appeal [Referencia INCADAT: HC/E/UKe 182].

Reino Unido: jurisprudencia de Inglaterra y Gales

El Tribunal de Apelaciones inglés ha adoptado un enfoque muy estricto respecto del artículo 13(1)(b) y, en efecto, la excepción se admite en contadas oportunidades. Los siguientes casos constituyen ejemplos en los que se estimó configurada la excepción:
